Student Debt

Student Debt Attorney in Cook County, Illinois

A Strategy From Our Cook County Student Debt Team Built Around Your Full Financial Picture

Student debt problems rarely exist in isolation. We review your debts, current financial circumstances, and long-term priorities before recommending a legal strategy. At Attorney Joseph P. Doyle, our consumer rights work addresses repayment pressure, collection activity, and related financial concerns.

We consider immediate problems and the issues you may face after bankruptcy. That can include preserving your home, responding to wage garnishment, addressing other unsecured debt, or determining whether a repayment program offers a workable alternative.

Discuss student debt relief in Cook County, Illinois, during a free consultation. Call (312) 957-8077 to review your circumstances and discuss possible next steps.

Student Debt & Financial Relief Options

The right approach depends on the loan type, repayment history, income, other debts, and your goals. We evaluate available repayment and debt-relief options, including whether bankruptcy may be appropriate when education debt is part of a broader financial burden.

Federal and private education loans operate under different rules. We explain those distinctions and discuss programs designed for qualifying public employees and educators in Chicago and Cook County, Illinois. Eligibility for a federal program depends on the borrower, employer, loan type, and payment record.

Our debt-relief services include:

  • Chapter 7 bankruptcy filings
  • Chapter 13 bankruptcy filings
  • Student loan modification
  • Student loan consolidation
  • Student loan forgiveness

Public Service Loan Forgiveness

Public Service Loan Forgiveness can forgive the remaining balance on eligible federal Direct Loans after 120 qualifying monthly payments while the borrower works full-time for a qualifying public service employer. Federal loans that don’t qualify directly may need to be combined into a Direct Consolidation Loan before qualifying payments can count. We explain how these requirements may apply without assuming that a particular borrower or loan is eligible.

Can Student Loans Be Discharged in Bankruptcy?

Student loans are generally not dischargeable in an Illinois bankruptcy unless repayment would impose an undue hardship. This legal standard requires more than ordinary difficulty repaying debt. We assess whether Chapter 7 or Chapter 13 could be a reasonable step based on your complete circumstances.

Courts in the Seventh Circuit typically apply the Brunner test when evaluating undue hardship. The test considers three issues:

  • Whether repayment would prevent the borrower from maintaining a minimal standard of living.
  • Whether the hardship is likely to continue through a significant portion of the repayment period.
  • Whether the borrower has made good-faith efforts to repay the loans.

The Adversary Proceeding

Seeking a discharge of education debt requires an adversary proceeding, a separate lawsuit filed within the bankruptcy case. After reviewing the evidence and applying the governing legal standard, the court may discharge all, part, or none of the debt. Filing bankruptcy alone doesn’t assure a discharge.

Chapter 7 & Chapter 13 Considerations

A discharge may be pursued under either chapter when the required legal standard can be proven. A Chapter 13 case also involves payments under a court-set plan that generally lasts three to five years before remaining eligible debts are discharged. We examine income, assets, other obligations, and financial priorities when explaining which chapter may be appropriate.

How Bankruptcy May Affect Collection Activity

A bankruptcy filing generally triggers the automatic stay, a court-ordered pause on many forms of collection activity. Depending on the case and applicable court orders, the stay can affect collection calls, required payments, and wage garnishment until the case ends or a judge permits collection to resume.

The automatic stay doesn’t erase student debt, and its duration and scope can vary. We provide court representation for Cook County clients facing creditor actions and address wage garnishment concerns as part of our debt-relief services.

Preparing for a Cook County Student Debt Review

Our initial review begins with what has been happening, the types of debt involved, and what you want a legal strategy to accomplish. We ask clients to gather pay stubs, tax returns, and creditor information so we can evaluate the full financial picture using concrete records.

We then develop options around your priorities, which may include education debt, home protection, creditor disputes, or relief from other obligations. Our student debt lawyer in Cook County explains the available paths, important eligibility requirements, and issues that may continue after bankruptcy.
