Student Debt Attorney in DuPage County
Student Loan Options Based on Your Financial Picture in DuPage County, IL
Student loans don't always exist in isolation. Credit card balances, medical bills, missed payments, wage garnishment, and housing expenses can all affect which form of relief makes sense. We evaluate education debt alongside these obligations so any proposed strategy reflects your complete financial circumstances.
At Attorney Joseph P. Doyle, we provide personalized solutions for individuals facing financial pressure. Depending on your circumstances, we may review student loan modification, student loan consolidation, student loan forgiveness guidance, or bankruptcy. We explain the available options so you can make informed decisions about your financial future.

Can Student Loans Be Discharged in Bankruptcy?
Educational loans may be discharged in bankruptcy if the borrower proves undue hardship. Under 11 U.S.C. § 523(a)(8), covered debt generally remains due unless repayment would impose this hardship on the debtor and the debtor’s dependents. Whether a borrower meets this demanding standard depends on the facts of the case.
In the Seventh Circuit, courts typically apply the Brunner Test. A borrower generally must establish all three elements:
- Minimal Standard of Living: Whether the borrower can maintain a minimal standard of living while repaying the education debt.
- Persistence of Circumstances: Whether the financial circumstances are likely to continue for a significant portion of the repayment period.
- Good-Faith Repayment Effort: Whether the borrower has made a good-faith effort to repay the debt.
Discharge isn’t automatic when the bankruptcy court eliminates other qualifying debts. The borrower must request a determination through an adversary proceeding, a separate lawsuit filed within the broader bankruptcy case. We can assess whether this option may be appropriate, but the outcome depends on the evidence and individual circumstances.
The Department of Justice and Department of Education issued guidance in November 2022 to encourage more consistent evaluation of these claims. The framework includes a standardized attestation addressing income, necessary expenses, and repayment history. It doesn’t eliminate the statutory requirement or guarantee a discharge.
Chapter 7 & Chapter 13 for DuPage County Borrowers
Bankruptcy can affect more than education debt. Discharging qualifying unsecured obligations, such as certain credit card or medical debt, may change a borrower’s overall budget even when educational loans remain. We evaluate how liquidation and repayment-plan bankruptcy may affect the complete debt picture.
Chapter 7 and Chapter 13 bankruptcy are as follows:
- Chapter 7 Bankruptcy: Eligibility typically includes a means test, which compares the borrower’s income with the applicable Illinois median and considers other required financial information. A case generally takes four to six months from filing to discharge. Eliminating education debt requires the separate determination described above.
- Chapter 13 Bankruptcy: This option generally uses a three-to-five-year repayment plan, with the borrower making one monthly payment to a trustee. After the plan is completed, remaining qualifying unsecured debts may be discharged. Educational obligations generally remain unless the borrower separately establishes the required standard.
Neither option is automatically right for someone with unmanageable education debt. Income, assets, household expenses, secured debts, collection activity, and long-term goals can all affect the decision. We develop a tailored strategy after reviewing the borrower’s complete financial situation.
